Intellectual property includes all original ideas, designs, discoveries, inventions and creative work produced by an individual or a group. Copyright, trademark, patent and design are some of the most common forms of IP protection.

IP protection is necessary not only to protect innovations, but also as a means to incentivize the creator or owner of the intellectual property by giving him the rights to benefit from the said innovation, to the exclusion of all others for a certain period of time . An organization that owns intellectual property can monetize it through its own processes and also by allowing outside parties to use the intellectual property by entering into licensing and royalty rights agreements.

Copyright registration

An original intellectual work in the literary, artistic or scientific field, regardless of its description, expression, meaning or purpose, is protected under UAE copyright law. The UAE Ministry of Economy allows copyright registration and once approved, copyright remains valid for the entire lifetime of the owner and plus fifty (50) years after death.

Trademark registration

Trademarks include all distinctive marks such as names, letters, numbers, logos, titles, quality marks, images, patterns, sound marks, words used or intended to be used to distinguish a good, product or service. The Ministry of Economy in the UAE allows trademark registration and once the right is granted, it is valid for a period of 10 (ten) years and can be renewed for another period.

Patent registration

Patent protection and registration are allowed for any new invention that constitutes an innovative step or an improvement on an existing invention and has a useful, industrial application in various fields of technology. The International Center for Patent Registration (ICPR) under the Ministry of Economy is the competent authority for registering patents in the UAE. Once a patent is granted, it is valid for twenty years from the date of filing.

When you plan to protect your company's intellectual property, in addition to initiating the registration of your intellectual property, you should also consider additional steps such as including confidentiality and non-disclosure agreements, protecting domain names and also considering investing in technology to provide you with methods to protect the trade secrets that make your business unique. Proceeding with the registration of your IP in the UAE at the earliest and ensuring its continued use is critical to ensuring maximum protection of your IP and being able to claim priority over others.
