IaaS providers face a common challenge: customers install unlicensed software on their infrastructure, leading to audit requirements. Even if the provider hasn't installed the software, proving a Bring Your Own License (BYOL) agreement can be difficult.

To mitigate this risk, ensure that your contracts clearly state the customer's responsibility for software licensing and compliance. Include clauses relating to:

– Software installation and licensing: Customer is solely responsible for obtaining and maintaining all necessary licenses.
– Compliance and reporting: Customer must comply with all license terms and accurately report usage.
– Provider's right to audit: The provider may audit the customer's software usage to ensure compliance.
– Indemnification: The client indemnifies the provider against any claims arising from failure to fulfill the obligations.
